Arts. 126-129: one paid weekly rest day at last week's average. If you work that day (qualified cases only), the hours are overtime at +50%, not a “double Sunday”. Educational estimate, not legal advice.

Quick answer: Q5,000 ÷ 30 → week Q1,166.67

Default: jornal Q166.67 (Q5,000 ÷ 30) and 6 days → ordinary Q1,000.00 + seventh Q166.67 = Q1,166.67. A monthly employee does not get another day: the month already includes seventh days.

Article 126 gives one paid rest day after each work week. Article 129 sets the amount: the average daily ordinary plus extraordinary pay from the week just before the rest. If you are required to work that day (qualified cases, art. 128), the hours are overtime at +50% (art. 121). The Code does not say “double Sunday”.

Frequent mistakes

MistakeRule
Paying only 6 day-wagesThe 7th day is mandatory and paid
Calling it “double Sunday”It is paid rest + overtime +50%
Adding another seventh to a monthly salaryThe month already includes it
Ignoring extras in the averageArt. 129 raises the seventh if there was overtime

If a holiday falls on the rest day, both rights are paid. Use worked holiday for art. 127 and overtime for +50% on an ordinary day.

The rest day still exists. The average uses what you earned those days (art. 129).

If there was no overtime, yes. Commissions or extra hours that week raise the average.
